01. SCOPE &
APPLICATION OF TARIFF
This tariff shall be applicable to terminal facility at any location so
appointed by the terminal operator at USCG Approved facilities within the
continental United States
02. PRECEDENCE OF
OCEAN CARRIER SERVICE AGREEMENTS, UNION COMPACT, AND CONFERENCE TARIFFS:
Relevant provisions of applicable Ocean Carrier Service Agreements or
Conference tariffs, ILA or similar portside labor organization, shall not
take precedence over nor supersede the analogous provisions of this tariff.
03. TERMINAL
SERVICES:
Nothing contained herein shall be construed as requiring
the terminal operator to perform, without charge, any service not
specifically provided for herein. The charge
for any such service shall be mutually agreed upon.

04. LIABILITY:
In no case shall the terminal operator be liable for a sum in excess of
$500.00 per package unless the trucker, Shipper or Consignee or their
representatives, prior to the commencement of such services, declares a
higher value and pays to the terminal operator, in addition to the other
charges for such services as set forth, a premium computed at one (2.25%) percent
of the declared value of each package and in such event the terminal operator
shall be liable for the full declared value (but in no case for more than the
actual value) of each such package for damage resulting from its failure to
exercise due and proper care in performing the services provided for herein.

DEFINITIONS:
A. CONTAINER: Refers to any fully enclosed, reusable freight container of
rectangular configuration, used for the repeated shipping of a number of
smaller packages or bulk material. Said container may be collapsible, rigid
or mobile, however, it must confine and protest its contents
from loss or damage and must be susceptible to being handled in transit as a
unit. (The so-called "vans" used in connection with the shipment of
household goods (as
defined below) are not included within this definition and they are not
subject to the rules, regulations and rates herein affecting containers).
B. HEAVY LIFT: Refers only to single packages weighing 6,001 lbs. or more;
provided, however, that individual
airplanes, boats, containers and metals shall not be deemed heavy lifts.
C. INTACT CONTAINER: A reusable non-disposable shipping container for intact
movement requiring no stripping
or stuffing of contents by the terminal operator.
D. HOUSEHOLD GOODS: Refers to personal belongings and household furnishings
which are shipped, in specialty constructed vans. Vans must be constructed to
permit
free access of fork lift blades and so as to provide a balanced load when
lifted by a 3 ton fork lift.
E. OPEN FLAT BED TRUCK (OFBT): Refers to a truck having no sides and
tailgate, as well as to one from which the sides and tailgate have been
removed by the truck driver
prior to loading and/or unloading operations.
F. OTHER TRUCK: Refers to closed or rack-open top truck (unless racks are
removed by driver, prior to receiving
service).
G. PACKAGE: a commodity or a unit of a product uniformly wrapped or sealed, a
preassembled unit, cargo, box, or
bundle. It shall also include pieces, unpackaged freight units and all
articles of any description except goods shipped in bulk.
H. PIER CONTAINER: A reusable, non-disposable shipping container requiring
stripping or stuffing of contents by
terminal operator.
I. PRE-UNITIZED AND PALLETIZED CARGO: Refers to packages mounted on a
prepared platform (and, in the case of pre-unitized cargo, stopped together)
in such a way as to form a single unit, which may be handled at the terminal
facility by a 3 ton fork lift. To be acceptable, the platforms must be made
of wood, plastic, paper or metal,
and shall rest on, and be fastened to, runners of steel or wood, with
openings wide enough to permit free access
of fork lift blades and so spaced as to provide a balanced load when lifted.
In addition, the dimensions of the total unit (I. e. platform with packages)
shall
not exceed 48 in. in width, 120 in. in length and 84 in. in height.
J. REFRIGERATED CARGO: Reefers to cargo which must be maintained at
temperature of 32 degrees Fahrenheit or lower.
K. Skidded Cargo: Refers to boxes, cases and/or cartons to which runners of
steel or wood have been positioned such a way as to permit free access for
the blades of a 3 ton fork lift and to provide a balanced load when lifted.
To be acceptable, such units shall not exceed 48 in. in width, 120 in. in
length and 84 in. in height.
L. TERMINAL FACILITY: One or more structures comprising a terminal unit and
including, but not limited to, wharves,
warehouses, covered and/or open storage space, cold storage plants, grain
elevators, and/or bulk cargo loading and/or unloading structures, landings,
and receiving stations, used for the transmission, care and convenience of
cargo and/or passengers in the interchange of same between land and water
carriers or between two water carriers.
M. TERMINAL OPERATOR: Refers to Mariner's Harbor Cargo Terminal, Inc.
N. TON: Refers to a net ton of 2,000 pounds.
O. TRANSSHIPMENT CARGO: Is cargo moving on through Bills of Lading from one
terminal facility for movement to another terminal facility for transshipment
between a common carrier by water and another common
carrier by water. The through freight must include the transshipment costs
and the truck, rail or lighter loading and unloading charges are to be
absorbed by
either the initial carrier and/or the connecting carrier.
Where two or more commodities are moving together on a through Bill of
Lading, the transshipment rate is to apply to all commodities on such Bill or
Bills of Lading.
When a single commodity is being transhipped on a through
Bill or Bills of Lading, the applicable tariff rate is
to apply.

06. Terminal
Gate Charges
a. Receiving and Deliver
The following charge is applied for vehicles entering or exiting
Terminal, whether as cargo or draying containerized, bulk, breakbulk,
or palletized cargo, and not applicable to towing or auto hauling vehicles
delivering the cargo.

08. FREE TIME
DEMURRAGE ON EXPORT CARGO:
1. DEFINITIONS:
A. FREE TIME - The specific period during which cargo may
occupy space assigned to it on a terminal facility free
of demurrage immediately prior to the loading of such
cargo on the vessel.
B. DEMURRAGE - A charge assessed against the cargo remaining in or on
terminal facilities after the expiration of free time.
2. FREE TIME PERIOD - Free Time on export cargo shall not be more than ten
(10) days (exclusive of Saturdays, Sundays and legal holidays) except:
A. Upon the request of the U. S. Government to the Terminal Operator, free
time not to exceed fifteen (15) days (exclusive of Saturdays, Sundays and
legal holidays) may be granted. This exception shall apply only to
commodities shipped for the account of the U. S.
Government.
B. Upon the request of the export shippers or their agents to the Terminal
Operator, free time not to exceed fifteen (15) days (exclusive of Saturdays,
Sundays and legal holidays) may be granted to cargoes moving in the trades
serviced by the Terminal Operators, provided that such cargoes are delivered
to the terminal not more than fifteen (15) days (exclusive of Saturdays,
Sundays and legal holidays) prior to the sailing for which they are booked,
and provided further that they are not held beyond such fifteen (15) day
period through any fault or design of the export shipper or his agent. In
either case, demurrage charges shall apply after the passage of ten (10)
days, (exclusive of Saturdays, Sundays and legal holidays) may be granted in
addition to the ten (10) days free time provided above. Cargo upon which such
consolidation time has been granted shall be designated on dock receipts as
"hold on dock for consolidation".
Cargo not so designated and cargo not actually consolidated on piers will not
be entitled to the grant
of consolidation time. As used in this section, the "consolidated
shipments" shall mean shipments which are
made up of commodities from two or more supply points and which move under a
single Bill of Lading to overseas Consignees.
D. On project cargo, an assembly period, not to exceed forty-five (45)
consecutive calendar days, may be granted for consignments of cargo being
assembled for shipment in large lots. Such assembly shipments shall be held in
open or covered storage at the discretion of the Terminal Operator. Such
assembly time shall be granted at the discretion of the management of the
marine terminal and only when arrangements are made in advance of the arrival
of the cargo at the port terminal facilities and only when adequate storage
space is available.
E. On intact containers, free time shall not be more than more than ten (10)
days (exclusive of Saturdays, Sundays and legal holidays).
3. COMPUTATION OF FREE TIME PERIOD - Free time on cargo shall commence at
12:01 am on the day after the said cargo is received at the terminal facility
and terminate at 11:59 pm on the final day of free time. Consolidation time
on export cargo shall commence at 12:01 am on the day following the last day of
free time and terminate at 11:59 pm on the final day of consolidation time.
4. SCALE OF DEMURRAGE CHARGES - At the expiration of free time period, or if
consolidation time has been granted, the consolidation time period, demurrage
shall be assessed in accordance with the following rates and provisions:
A. Breakbulk Cargo:
1st Period Demurrage:
2 cents per 100 lbs. or 1 cent per cubic foot, whichever
is greater, per day, or fraction thereof, for the first
five (%) calendar days after the expiration of free
time. Minimum charge $5.50 per day.
2nd Period Demurrage:
5 cents per 100 lbs. or 3 cents per cubic foot,
whichever is greater, per day, or fraction thereof, for
the next five (5) succeeding days. Minimum charge
$11.00 per day.
3rd Period Demurrage:
7 cents per 100 lbs. or 4 cents per cubic foot whichever
is greater, per day, or fraction thereof, for each
succeeding day. Minimum charge $16.50 per day.
B. House Containers:
1. General cargo containers of which no dimension exceeds 20 feet, a charge
of $21.00 per day per container for the first five (5) calendar day after
expiration of free time and $51.00 per calendar day per container thereafter.
2. General cargo containers of which no dimension exceeds 40 feet, a charge
of $31.00 per day per container for the first five (5) calendar days after
expiration of free time and $81.00 per day per container thereafter.
C. Saturdays, Sundays and legal holidays shall be included in computing
demurrage. No demurrage shall be assessed after the vessel has commenced to
load.
D. Except as otherwise provided in this section, demurrage shall be for the
account of the cargo.
E. When the vessel for any reason fails to meet the announced date of
sailing, any demurrage accruing after such date shall be assessed in successive
periods for the account of the vessel until the vessel commence to load.
F. In the case of a vessel cancellation, cargo on free time, or if a vessel
has been designated, cargo on
consolidation time, on the announced date of sailing shall be subject to
first period demurrage assessed
against the vessel commencing on the day when the cargo was received at the
terminal facility and terminating on the said announced date of sailing
unless the export shipper on or before that date has another vessel designated
for loading, removes the cargo from the terminal, or elects storage if same
is provided.
G. If the export shipper takes none of the action mentioned in subparagraph
(F) of this item, demurrage charges in successive periods shall be assessed
against the export shipper after the vessel's liability for demurrage has
expired. Such demurrage shall likewise terminate upon the export shipper's
action as aforesaid. For cargo on demurrage on the canceled date of sailing,
demurrage shall continue for the account of the export shipper until such
time as he takes one of the said actions. In the event the export shipper has
another vessel designated, the provisions of 2.A, above shall apply, with the
free time for the other vessel commencing on the date that the export shipper
has this other vessel designated.
I. When the loading of cargo into a vessel is prevented by any factor
immobilizing the pier facility or facilities
in all or in part, such as weather conditions, strike, or work stoppage of
longshoremen or personnel employed by the terminal operator or water carrier,
cargo affected thereby shall be granted additional free time of demurrage to
cover the delay if the cargo is on free time or consolidation time when such
condition arises. If cargo is on demurrage, first period demurrage charges
shall be assessed against such cargo.
J. At the time export cargo is received by the pier facility a dock receipt
shall be issued evidencing receipt of the cargo, which shall show the date of
receipt and, except for cargo designated on dock receipts or other
appropriate shipping documents as "hold-on-dock for consolidation",
shall identify the vessel on which the
goods are to move. The identification of the vessel is made for the purpose
of determining the application of the foregoing paragraphs E. and I. of this
section.
5. TRANSFER OF OWNERSHIP OF CARGO FOR EXPORT - The transfer of ownership of
cargo for export after said cargo has been received at a terminal facility
shall not entitle such cargo to additional free time.
6. REMOVAL OF EXPORT CARGO FROM TERMINAL FACILITIES PRIOR
TO LOADING INTO VESSEL -
A. Subject to the provision of Item 4, if the export cargo is not loaded into
a vessel and is, at any time, removed from the terminal facility, the said
cargo shall be subject to demurrage rules and charges set forth above. Said
charges shall be assessed from the day the cargo was received at the terminal
facility to the day of its removal therefrom.
B. In addition, said cargo shall be responsible for the receipt and delivery
labor costs incurred by the Terminal Operator as a consequence thereof.
7. RESPONSIBILITY FOR PAYMENT OF DEMURRAGE AND OTHER
CHARGES -
A. Except as otherwise provided, demurrage and other charges specified
herein, shall be for the account of the cargo.

09. FREE TIME
DEMURRAGE ON IMPORT CARGO:
1. DEFINITIONS:
A. FREE TIME - The specified period during which cargo
may occupy space assigned to it on a terminal facility
free of demurrage sifter discharge of such cargo onto
the terminal facility.
B. DEMURRAGE - A charge assessed against the cargo
remaining in or on terminal facilities after the
expiration of free time.
2. FREE TIME PERIOD:
A. Breakbulk Cargo:
Five (5) days free time exclusive of Saturdays, Sundays and legal holidays
will be allowed for the removal of
import cargo discharged from vessels, except that, green coffee beans in bags
and cocoa beans in bags will be allowed ten calendar days and no free time
will be allowed on cargo which is of specific nature as to require earlier
removal because of local ordinances or other governmental regulations or
because
piers are not equipped to care for such property for such period, such as,
but not restricted to:
1) Cargo in bulk
2) Oils and/or liquids in bulk, in ship's tank
3) Animals and birds, live
4) Bullion and treasure
5) Dangerous and hazardous cargo
6) Jewelry, precious stones, etc.
7) Refrigerated cargo
B. Containerized Cargo (House Containers):
1. General cargo containers and tank containers:
Five (5) days free time exclusive of Saturdays, Sundays and legal holidays
will be allowed for the
removal of containers discharged from vessels in Port.
2. Refrigerated Containers (House Containers):
Two days free time exclusive of Saturdays, Sundays or legal holidays will be
allowed for removal of
containers discharged from vessels.
3. Containers of green coffee beans in bags and cocoa beans in bags will be
allowed ten days free time
exclusive of Saturdays, Sundays and holidays.
3. COMPUTATION OF FREE TIME PERIOD:
Free time on import cargo/containers shall commence at 12:01 am on the day
after discharge of the vessel at the terminal facility and terminate at 11:59
on the final day of free time.
4. SCALE OF DEMURRAGE CHARGES:
The following scale of demurrage rates and provisions will apply to cargo
remaining undelivered sifter the
expiration of free time:
A. Breakbulk Cargo:
1st Period Demurrage:
4 cents per 100 lbs. or 3 cents per cubic foot,
whichever is greater, per day, or fraction thereof,
for the first five (5) calender days after the
expiration of free time. Minimum charge $16.50 per
day.
2nd Period Demurrage:
6 cents per 100 lbs. or 4 cents per cubic foot,
whichever is greater, per day, or fraction thereof,
for the next five (5) succeeding days. Minimum charge
$22.00 per day.
3rd Period Demurrage:
9 cents per 100 lbs. or 5 cents per cubic foot
whichever is greater, per day, or fraction thereof,
for each succeeding day. Minimum charge $27.50 per
day.
B. Containers:
1. General cargo containers of which no dimensions exceeds 20 feet, a charge
of $25.00 per day per container for the first five (5) calender days after
the expiration of free time and $55.00 per calendar day thereafter.
2. General cargo containers of which no dimensions exceeds 40 feet, a charge
of $35.00 per day per container for the first five (5) calender days after
the expiration of free time and $80.00 per calendar day thereafter.
3. Temperature controlled containers, a charge of $150.00 per day per
container for the first three (3) calendar days after the expiration of free
time and $180.00 per calendar day per container thereafter.
C. Intermodal Moves (Carrier Controlled):
Demurrage charges after the expiration of free time shall be charged the
following rates, which charges are to be assessed the Carrier, and not the
cargo:
Five (5) Calendar Days 1st Period Thereafter
20' Container $25.00/day $55.00/day
40' Container $35.00/day $80.00/day
Temperature Controlled $150.00/day $180.00/day
5. UNDELIVERED CARGO:
A. Cargo which is undelivered and remains at the terminal beyond the
expiration of free time, may be placed in public storage at any time
thereafter, at the option of the terminal operator and at the risk and
expense of the cargo.
B. Cargo remaining on the terminal in excess of 30 days will be considered
abandoned and sold for collection of demurrage charges due the operator. Ten
days prior to such sale, a registered receipt letter of notice will be sent
to the owner of record. Any monies received beyond the charges due, will be
returned to the owner of claimed cargo within one year of the mailed notice.
6. TRANSFER OF OWNERSHIP OF CARGO:
The transfer of ownership of cargo after said cargo has been received at a
terminal facility shall not entitle
such cargo to additional free time.
7. RESPONSIBILITY FOR PAYMENT OF DEMURRAGE AND OTHER CHARGES
A. Except as otherwise provided, demurrage and other charges specified
herein, shall be for the account of the cargo.
B. Demurrage and other charges shall be due and payable as they accrue.
C. The terminal operator has the right to require payment in full of any and
all such charges before such cargo leaves the terminal facility.
8. EXTENSION OF FREE TIME AND DEMURRAGE PERIODS:
A. Cargo on Free Time:
In the event the consignee or owner of the cargo should make application for
delivery of the cargo or portion thereof during the free time period and the
Terminal Operator should be unable for any reason to make available to the
Consignee or owner of such cargo or portion thereof, the free time shall be
extended for a period equal to the duration of the Terminal Operator's
inability to make the cargo available.
B. Cargo in first period or succeeding periods:
Where the Consignee is prevented from removing his cargo by factors beyond
his control, such as, but not limited to, longshoremen's strikes, trucking
strikes or weather conditions which affect the entire port area or a
substantial portion thereof; or
Where a Consignee is prevented from removing his cargo by a longshoremen's
strike which affects only one pier or less than a substantial portion of the
area;
Then, in either event, cargo which is in the first period demurrage will
continue to be assessed at the first
period demurrage rates, and cargo which is in the second period demurrage or
in any succeeding period after the second period demurrage will revert to the
first period demurrage charges for such time as the Consignee is prevented
from removing his cargo by such strike or factors beyond his control.
C. Following a longshoremen's strike of five (5) days or greater duration:
1. Cargo which is on free time at the commencement of the strike will be
extended an additional free time
period of not less than five (5) days, exclusive of Saturdays, Sundays or
legal holidays, beyond the time
at which the free time period would normally terminate; and
2. Cargo which is in the first period demurrage at the commencement of the
strike will be extended an
additional first period demurrage of five (5) calendar days beyond the time
at which first period demurrage
would normally terminate.
This extension referred to in sub-paragraph 1. and 2. above shall apply only:
a. If cargo is actually picked up within such extended time; or
b. If, pursuant to an appointment system adopted by both Carriers and
Consignees, cargo is picked up within twenty-four hours of advance
notification that cargo is available for pickup and readily accessible, in
which
letter event time shall not be extended more than twenty-four (24) hours
beyond the additional free time or the demurrage period.
3. Cargo which is on second period demurrage (or any succeeding demurrage
period) at the commencement of the strike shall revert to such demurrage
period at the conclusion of the strike.
D. Delays in Delivery - Carrier errors or omission:
In the case of an error or omission, which was solely caused by the steamship
line, its duly appointed agent
or authorized representative, excluding the stevedore or terminal operator,
and said action or inaction prevented the Consignee or owner of the cargo
from taking or effecting delivery of cargo, an adjustment to demurrage may be
made. These specific conditions must be completely documented and specific
period of time in which the delivery was prevented by the action of the
parties named above. Any adjustment may not be for any additional periods to
which the Consignee or owner of the cargo was partially or solely
responsible. The adjustment will be limited to charging $5.00 per day per
container for the period in which delivery was prevented.

10. FREE TIME AND
DEMURRAGE ON EMPTY CONTAINER OR CHASIS:
1. PURPOSE:
The purpose of this part is:
A. To define and set tariff rates and rules applicable to
circumstances resulting from the cessation or
transportation services by a terminal facility user.
Cessation may occur for any reason, including, but not
limited to bankruptcy, discontinuance of service, acts
of God, acts of government.
B. To insure the Terminal Operator a fair charge for the use of his
facilities, labor and equipment, when containers and/or chassis are not used
for commerce.
2. DEFINITIONS:
A. A container is defined as a cargo carrying unit usually measuring from 20
feet to 45 feet in length by 8
feet in width and 8 or more feet in height or a platform 20 feet to 45 feet
in length by 8 feet in width,
designed for the purpose of direct transfer of the unit and its contents to
and from sea going vessel. The unit may also be a tank for liquids mounted on
a platform, a bin or a bolster used for similar purpose.
B. A chassis is a vehicle designated and built to carry containers or
platforms with facility for tractor
coupling for transport.
C. Free time is the specified period a container or chassis may occupy space
assigned to it on a terminal free of charge.
D. Demurrage is a charge assessed against a container and/or chassis after
the expiration of free time.
E. Terminal facility user is any person or entity, including but not limited
to, vessel operator, vessel owner, container lessor or lessee utilizing a
terminal facility, and services provided thereon or thereat or both.
3. COMPUTATION AND NOTICE OF FREE TIME:
A. Free time on containers and/or chassis shall not be more than five (5)
days (exclusive of Saturdays, Sundays and holidays) and shall begin after
notice has been mailed by certified mail to the terminal facilities users at
their last known address, if known.
B. Notice shall set forth the fact that demurrage begins, the length of the
first period and the time the second period of demurrage shall begin. The
notice shall also set forth the condition and the charges which must be paid
before a container and/or chassis will be delivered.
C. Free time on containers and/or chassis shall commerce at 12:01 a.m. on the
day after notice has been given the facility users.
4. SCALE OF DEMURRAGE CHARGES:
The following scale of demurrage rates and provisions will apply to confiners
and/or chassis remaining
undelivered after the expiration of free time:
A. Empty containers of which no dimension exceeds 20 feet, or chassis for 20
foot containers, a charge of $5.50 per day for the first thirty (30) calendar
days after the expiration of free time and $11.00 per day per calendar day
per container and/or chassis thereafter.
B. Empty containers exceeding 20 feet, in length or chassis in excess 20 feet
in length, a charge of $11.00 each per day for the first thirty (30) calendar
days after the expiration of free time and $22.00 each per day per calendar
day per container and/or chassis thereafter.
5. EXTENT OF FREE TIME OR SUSPENSION OF DEMURRAGE:
A. When the removal of containers or chassis from a terminal is prevented by
any factor immobilizing the facility in whole or in part, including but not
limited weather conditions or work stoppage of longshoremen or personnel
employed by the Terminal Operator, such containers and/ or chassis affected
thereby shall be granted additional time free of demurrage to cover the delay
period if the condition arises. If the container and/or chassis is in the
demurrage period, first period demurrage charges shall be assessed against
such containers and/or chassis.
B. Following a longshoremen's strike of five days or more:
1. Containers and/or chassis which are on free time at the commencement of
the strike will be extended an
additional free time period of not less than five (5) days exclusive of
Saturdays, Sundays and legal holidays, beyond the time at which free time would
normally terminate, and
2. Containers and/or chassis which are in first period demurrage at the
commencement of the strike will be
extended an additional free time period of not less than five (5) calendar
days beyond the time first
period demurrage would normally terminate.
C. The foregoing extensions or suspensions shall apply only:
1. If such containers and/or chassis are picked up within such extended free
time, or
2. If, pursuant to an appointment system facility user the containers and/or
chassis are picked up within
twenty-four hours of advance notification that such units are available for
pickup and readily accessible.
D. Containers and/or chassis which are in second period demurrage at the
commencement of a strike shall revert to such demurrage at the conclusion of
the strike.
6. UNDELIVERED CONTAINERS AND/OR CHASSIS:
A. Containers and/or chassis which remain at a terminal
beyond the expiration of free time may be placed in
public storage at any time thereafter at the option of
the Terminal Operator at the risk and expense of the
containers and/or chassis and the terminal users.
B. Containers and/or chassis reaming on the terminal in
excess of sixty (60) days will be considered as abandoned
and sold at public auction for collection of charges due
the terminal operator. Ten days prior to such sale, a
registered letter of notice will be sent to the terminal
users or the Terminal Operator will take other reasonable
steps to advise those terminal users of whose interest in
the equipment he is aware. Net proceeds of such sale
less expense will be held in a separate fund out of which
the Terminal Operator shall be paid his charges. Moneys
received beyond the charge due the Terminal Operator will
be returned to the owner if claimed within one year of
the mailed notice.
7. TRANSFER OF OWNERSHIP OF CONTAINERS AND/OR CHASSIS:
The transfer of ownership of containers and/or chassis
after receipt at the terminal shall not entitle such
containers and/or chassis to additional free time.
8. DELIVERY AND MOUNTING CHARGES:
On delivery the terminal facility users shall be charged
for gate services, mounting of containers on chassis or
flat bed trucks and segregating containers from stack as
applicable.
9. RESPONSIBILITY FOR PAYMENT OF DEMURRAGE AND
OTHER CHARGES:
A. Demurrage and other charges specified herein shall be for the account of
the terminal facility users.
B. Demurrage charges shall be due and payable as they
accrue.
C. The terminal operator has the right to require payment
in full of any and all charges before such containers
and/or chassis are delivered from the terminal.

11. TRUCK LOADING
AND UNLOADING:
1. DEFINITIONS
A. Truck Loading - Shall mean the service of moving cargo
from place of rest on the terminal facility, elevating
the cargo onto the truck and stowing of the cargo in the
truck, but shall not include, among other things, special
stowage, sorting or grading of, or otherwise selecting,
the cargo for the convenience of the trucker or the
consignee, nor the loading of cargo onto consignee's
pallets.
B. Truck Unloading - When the terminal operator performs
truck unloading, such service shall consist of removing
from the body of the truck to a place of rest on the
terminal facility by the terminal operator, and shall
include sorting by port. Truck unloading shall be
performed by the terminal operator at the request of the
motor carrier.
ITEM 304 RIGHT TO LOAD AND UNLOAD TRUCKS:
2.RIGHT TO LOAD AND UNLOAD TRUCKS
A. Truck loading shall be performed solely by the agents,
servants and employees of the terminal operator in
accordance with the rules, regulations and practices in
this tariff. Such services shall be performed with the
assistance, and under the supervision, of the driver of
the truck; provided, however, that the terminal operator
may not be required to tier or stow cargo beyond a height
of six (6) feet.
B. Truck unloading shall be performed by the terminal
operator only upon request of the motor carrier, its
agents, its servants and/or employees; provided that
there is sufficient labor readily available to the
terminal operator to perform said services at the time of
said request and provided, further, that the cargo is so
situated on the truck that said services may be rendered
by the terminal operator in one continuous operation,
without interruption, until completion of the desired
services. Said truck unloading services shall be
performed with the assistance, and under the supervision,
of the driver of the truck.
C. Only trucks properly registered and licensed will be
serviced by the terminal operator. Equipment used for
truck loading and unloading will be furnished exclusively
by the terminal operator; no lift trucks, pallet jacks,
cranes, etc., other than those supplied by the terminal
operator will be permitted on the terminal facility.
D. Drive on or drive off from flat bed or low bed trucks
will be performed by employees of the terminal operator;
exceptions to this provision will require the truckman to
furnish a "hold harmless indemnity" to the terminal
operator.
ITEM 306 SAFETY:
3. SAFETY
The motor carrier, shipper or consignee shall provide a
vehicle which is adequate and suitable for safe loading
and unloading.
ITEM 308 APPLICATION AF RATES:
4. APPLICATION OF RATES
Rates are quoted in cents per 100 lbs., unless otherwise
noted and apply for loads of 10,000 lbs. Or one, with
the exceptions that items preceded by the symbol "(AO)"
are for any quantity, and the N. O. S. full truck rate at
25,000 lbs. and over.
If a single commodity consists of more than the minimum
truck load weight, the residue remaining for the last
truck of whatever weight, will be charged at the Truck
Load Rate.
Rates in this tariff apply only where the terminal
operator is not requested to select cargo by individual
marks of identification such as chop marks, brands, type,
size, etc. If selecting is desired, and such service
thereafter rendered, the rates will apply plus the
service charge applicable under "Special Handling" under
item 13.
Except where otherwise specifically provided for to the
contrary, whenever a minimum weight is given as
prerequisite to a rate in this tariff, the truckman,
shipper or consignee with less than said minimum weight
will be charged at the minimum weight, if such charge is
less than the otherwise applicable charge.
Unless otherwise specified to the contrary, where more
than one rate appearing in this tariff applies to a
specific item lowest rate shall take precedence.
ITEM 310 MISPLACED EQUIPMENT/CARGO BY A MOTOR CARRIER:

Provided clerking, checking and draying services
including equipment to locate and correct misparked
equipment/cargo by a motor carrier $70.00 per occurrence.
ITEM 312 COLLECTION FOR SERVICES RENDERED:
6. COLLECTION FOR SERVICES RENDERED
A. Unless the shipper or consignee shall have made definite
arrangements with the terminal operator for the payment
of loading or unloading charges, the motor carrier shall
assume full responsibility for the payment of the charges
for such service.
B. Invoices are due and payable at the office of issuance by no later than
ten (10) working days after rendition of truck loading and/or unloading
services. Failure to remit within the period above prescribed will result in
withdraw of credit. Thereafter and until such time as credit is
reestablished, all charges and/or invoices shall be paid in cash by the
driver after completion of said services and before departure of the truck
from the terminal facility. The driver shall be given a receipt of each such
payment
C. If a motor carrier fails to pay the charges specified
herein and/or it a motor carrier is extended credit
pursuant to the above provisions, and fails to pay said
charges, the shipper or consignee shall be liable for
such charge.
D. Existing credit listings maintained by the terminal
operator will continue to be recognized and companies
listed thereon shall continue to be extended credit in
accordance with the provisions of paragraph B above
subject to revocation as provided therein.
E. Companies not presently approved for credit by the
terminal operator may make application therefor in
writing directly to the terminal operator. Until such
time as approval for credit is granted, all charges and/
or invoices shall be paid in cash by the driver after
completion of services and before departure of the truck
from the terminal facility. the driver will be given a
receipt for each such payment.
F. Checks from companies having established with the
terminal operator will be accepted under the following
provisions:
1) Any company check returned NSF (insufficient funds)
will be assessed a fee of $55.00 for each occurrence.
2) Any company which has two (2) checks returned for NSF
within a thirty (30) days period will be subject to
cancellation of check acceptance privileges.
3) Acceptable methods of payment for companies which
check acceptance privileges have been canceled are
cash, certified checks, cashier checks, or wire
transfer.
4) Terminal operator may elect to establish a maximum
dollar amount for any checks to be accepted. Checks
in excess of this amount must be certified or a
cashier's check.
ITEM 314 RECEIPT AND DELIVERY OF CARGO AT AN APPOINTMENT
BASIS:
7. RECEIPT AND DELIVERY OF CARGO AT AN APPOINTMENT BASIS
Appointments for service will be made available at the
option of the terminal operator. Bookings for
appointments should be made by 11:00 am of the preceding
business day with the terminal operator. Special
equipment or discharging must be arranged at the time of
making appointments. Appointments may be made by the
terminal operator for delivery of cargo only after
freight release has been provided by the steamship
company. Trucks arriving after the time of scheduled
appointment may be denied service. Trucks arriving after
the time of scheduled appointment and those failing to
appear for their appointments shall be subject to a
charge of $16.50. A truckman will be deemed to have
missed his appointment if for any reason the vehicle or
the cargo is not in every aspect ready to work at the
appointed time.
ITEM 316 RECEIPT AND DELIVERY OF CARGO ON NON-APPOINTMENT
BASIS:
8. RECEIPT AND DELIVERY OF CARGO AT A NON-APPOINTMENT BASIS
The terminal operator shall make provisions for servicing
of non-appointment trucks that arrive at the terminal
before 4:00 pm. Non-appointment trucks will be assigned
service periods. Those trucks not wishing to wait for
their assigned service period may elect, not more than
thirty (30) minutes after receipt of gate pass, to
receive a preference slip entitling the trucker to
service on the next business day. Trucks arriving at the
terminal before 4:00 pm but after the capacity of said
terminal has been reached, may be turned away but will be
issued preference slips for service the next business
day.
ITEM 320 RESPONSIBILITIES OF MOTOR CARRIERS EMPLOYEES
IN TRUCK LOADING AND UNLOADING:
10. RESPONSIBILITIES OF MOTOR CARRIERS EMPLOYEES IN TRUCK
LOADING AND UNLOADING
A. When truck driver does not assist in the loading and
stowing of his truck the terminal operator shall make a
surcharge, in addition to the applicable tariff rate, of
$65.00 per straight time man hour, $98.00 per overtime
man hour, and $126.00 per penalty meal time man hour,
the time to be computed on the basis of each fifteen
(15) minute period or fraction thereof.
B. When trucks are unloaded without the services of the
terminal operator, unloading shall be completed within
the time specified under "Delay to Motor Carriers", such
time period to commence when the truck is spotted for
unloading. The terminal operator shall be entitled to a
payment of $4.40 for each fifteen (15) minute period or
fraction thereof in excess of specified time.
ITEM 323 HEAVY LIFTS:
11. HEAVY LIFTS
The handling of heavy lifts shall be limited to the
capacity of the terminal operator's equipment at the
terminal facility. The tariff rates set forth herein
for other than heavy lifts are applicable to single
packages weighing 6,000 lbs. or less.
Heavy lifts will be handled only at the discretion of
the terminal operator. Heavy lifts on other than OFBT
will be charged at triple the heavy lift rate, except
that heavy lifts on freely moving wheels will be charged
at the rates shown for heavy lifts on OFBT.
ITEM 325 PALLETIZED CARGO:
12. PALLETIZED CARGO
At the option of, and subject to prior arrangement with,
terminal Operator, cargo will be palletized on
consignees or truckman's pallets in advance of the
actual truck loading of said cargo. To be acceptable
for use, consignee's and/or truckman's pallets must be
serviceable and safe to handle.
The service of pelletizing shall extend only to the
stacking of cargo on said pallets; it hall not include
any strapping or otherwise securing of cargo to pallets.
A separate charge for this service shall be levied at
the man hour rates set forth under "Special Handling",
of this part and it will be assessed irrespective of
where said pelletizing takes place; provided, however,
that nothing herein shall be deemed to require the
terminal operator to perform said pelletizing service in
or on the body of a truck.
ITEM WEIGHING CARGO PRIOR TO AND AT TIME OF DELIVERY:
13. WEIGHING CARGO PRIOR TO AND AT THE TIME OF DELIVERY
When cargo is required to be weighed on the pier prior
to delivery, the terminal operator will endeavor to make
available the necessary space to permit such weighing to
be performed and for the weigh master to properly back
pile the cargo before the truck arrives to take
delivery. Where the cargo is palletized, the terminal
operator will assign lift trucks and operators to make
the cargo available to the weigh master for this
purpose.
The terminal operator shall not be required to permit
weighing simultaneously with the loading of the truck,
unless he has failed to make available to the weigh
master the space for prior weighing.
The weigh master shall be required to properly
repalletize cargo which had been palletized and to
properly back pile cargo that had not been palletized.
Where a truck in the process of loading is required to
make two or more trips to the Custom scale for the
purpose of obtaining separate weights for various lots
of merchandise, a fifty (50%) percent surcharge shall be
made on the applicable tariff rate for loading the
entire quantity delivered to the truck. Any overtime,
for use of the Custom scale for this purpose, shall be
ordered by and be for the account of the trucker.
ITEM 327 SPECIAL HANDLING:
14. SPECIAL HANDLING
If, any cargo has been sorted, graded and stowed and/or
assembled on the terminal awaiting delivery as per bill
of lading, the consignee, thereafter, desires additional
sorting, grading and/or specific selection of said cargo
in connection with the subsequent truck loading thereof,
a written request detailing the nature of the special
services desired must be submitted in advance of truck
loading to the terminal operator. If the terminal
operator agrees to perform these additional services,
an extra charge shall be assessed of $65.00 per straight
time man hour, $98.00 per hour overtime man hour, and
$126.00 per penalty meal time man hour, said charge to
be computed on the basis of each fifteen (15) minutes or
fraction thereof. A rental charge of $20.00 per hour or
any fraction thereof shall be made for the use of each
piece of motorized equipment used in connection with
such special services.
ITEM 328 DELAY TO MOTOR CARRIERS:
15. DELAY TO MOTOR CARRIERS
Motor carriers loading or unloading waterborne freight
at marine facilities of the terminal operator shall be
entitled to receive detention charges for delays
incurred beyond the time set forth below. Detention
charges shall accrue in instances where the delays
result through no disability, fault, or negligence on
the part of the motor carrier. No detention will be
allowed for delays or shut-outs resulting from strikes
or work stoppage, act of God, fire, serious or sever or
unusual weather conditions.

The lunch period as set forth in the labor contract, but
not exceeding one hour, shall not be including in
calculating detention time. Penalty charges shall accrue
against the terminal operator at the rate of 8.80 per
fifteen (15) minutes , or any fraction thereof in excess of
the above time.
Item 330 COMPUTATION OF TIME:
16. COMPUTATION OF TIME
Time to be computed in accordance with the following:
(a) Validation time is (1) time of issuance of a gate pass upon a motor
carrier's arrival at a marine terminal facility or (2) if, upon arrival, a
motor carrier is scheduled for a later service period, the time of
commencement of that scheduled service period, or (3) if a motor carrier is
issued a preference slip the time schedule thereon.
(b) Time for purposes of this item shall accrue from
validation or appointment time. Delay demonstrated by the
terminal operator to be due to United States Government
regulations, action or inaction of motor carrier personnel or other such
cause shall be excluded from computation of time. Time elapsed, if any,
between appointment or validation time and presentation of documents to the
delivery or receiving clerk shall be presumed to be due to such causes.
ITEM 332 PREREQUISITE FOR PALLETIZED AND SKIDDED RATE:
17. PREREQUISITE FOR PREPALLETIZED AND SKIDDED RATE
In addition to any other requirement specified
elsewhere, the following rules shall apply:
A. Wherever rates in this tariff are based upon cargo being palletized,
preunitized or skidded, said rates are
applicable in the case of truck unloading only if the cargo is situated on
the truck so the terminal's fork lift truck blades may be directly inserted
without any necessity of shifting cargo prior to such insertion. If the cargo
is not so situated on the truck, the N.O.S. rates are applicable.
B. In both loading and unloading situations, N.O.S. rates
shall apply if the pallets, platforms, skids, etc. are not serviceable and
safe to handle.
ITEM 334 OPENING AND CLOSING PACKAGES AND CONTAINERS

D. When a U. S. Government agency orders positioning of containers at the LCL
facility at the Terminal by Terminal, and/or during the devanning and
revanning of contents by U. S. Government agency personnel, a charge of
$120.00 will be assessed the party requiring the service.
E. U. S. Customs or A.Q.I. intensive examination of full containers requiring

B. PARTIAL SERVICE
Assisting inspection services in selecting samples for USDA inspection and
handling to and from vehicles of inspection services shall be charged at
$6.00 per sample.
ITEM 338 MOUNTING AND DEMOUNTING CONTAINERS:

For the mounting and demounting of intermodal containers from or to flat bed
trucks or chassis, as requested, there will be a charge of 63.00 per mount or
demount.
For the switching of out of gauge intermodal containers or flat racks
received or delivered on FCL basis to Flat bed trucks or trucker owned
equipment, as requested, a
rate of $265.00 will apply.
ITEM 340 TRAILER INSPECTION REPORT:

charge of $33.50 per unit.
ITEM 341 DOCUMENTATION:
22. DOCUMENTATION
Every motor carrier entering a terminal facility shall be in possession of
the proper shipping documents. In the case of dock receipts which may be
prelodged, the
truckman must obtain same from the pier office prior to entering the
facility. In the case of delivery orders they may not be prelodged and must
be in the possession
of the truck driver. Where there are multiple deliveries to be made against
an original delivery order subsequent drivers must possess either a duplicate
original which has an original signature or a copy of the original with a
covering letter on the trucking firm or broker's stationery containing an
original signature
of a company official.
Preparation, completion and/or correction of a deficient shipping document or
the handling of a preloaded order shall be assessed a charge of $16.50
against the party
requesting the service. This service will be performed at the Terminal
Operator's option.
ITEM 343 PROJECT SHIPMENT RATES:
23. PROJECT SHIPMENT RATES
Any interested party may apply in writing to the Terminal Operator requesting
truck unloading and storage rates on large advanced shipment being
consolidated for
movement by water carrier. Requests must include as much information as
possible; i.e. types of freight moving, amounts and weight of same and dates,
to permit
sufficient evidence on which to make a decision. The Terminal Operator, with
the Federal Maritime Commission in advance of the shipment, must file all
rates issued pursuant to such requests.
ITEM 344 NON-VESSEL OPERATORS OR NON-VESSEL COMMON CARRIERS:

Non-vessel operators or non-vessel common carriers can
apply to Mariner's Harbor Cargo Terminal, Inc. for a
lump sum charge for truck unloading on cargoes received

cargoes to be received and stuffed into containers at
Mariner's Harbor Cargo Terminal.

Charges for the loading and unloading of railcars will be assessed the rail
carrier or the party ordering the service performed in cases where the
railroad is not
responsible.
All charges rendered by the terminal operator for which credit is granted
shall be due and payable within seven (7) working days from the date of
billing.
ITEM 415 DELAYS:
3. DELAYS
The terminal operator will be responsible for delays which are shown to have
been caused by it or within its control. The terminal operator shall not be
responsible
for delays caused by but not limited to: incomplete documentation, strikes,
local work stoppage or weather condition.
ITEM 420 SPECIAL HANDLING
4. SPECIAL HANDLING
If, after cargo has been sorted, graded and stowed and/or assembled on the
terminal awaiting delivery as per bill of lading, the consignee, thereafter,
desires additional sorting, grading, and/or specific selection of said cargo in
connection with the subsequent rail car loading thereof, a written request
detailing the nature of the special services desired must be submitted in
advance of rail car loading to the Terminal Operator. If the Terminal
Operator agrees to perform these additional
services, an extra charge shall be assessed of $65.00 per straight time man
hour, $98.00 per overtime man hour, and $126.00 per penalty meal time man
hour, said charges to be computed on the basis of each fifteen (15) minutes
or fraction thereof. A rental charge of $20.00 per hour or any fraction
thereof shall be made for the use of each piece of motorized equipment used
in connection with special services.
ITEM 425 PROJECT SHIPMENT RATES:
5. PROJECT SHIPMENT RATES
Any interested party may apply in writing to the Terminal Operator requesting
special rail car unloading and storage rates on large advanced shipment being
consolidated for movement by water carrier. Requests must include as much
information as possible; i.e. types of freight moving, amounts and weight of
same and dates, to permit sufficient evidence on which to make a decision.
Any rates issued pursuant to such requests must be filed by the Terminal
Operator with the Federal Maritime Commission in advance of the shipment.
ITEM 500 LIGHTER LOADING AND UNLOADING:
1. DEFINITIONS
a. Lighter Loading - Consists of removing cargo from the terminal facility
and placing it on a lighter, covered barge, deck scow, et. b. Lighter
Unloading - Consists of removing cargo from the lighter, cover barge, deck
scow, etc. and placing
same on the terminal facility.

c. The rates specified in a. and b. above apply to pieces weighing up to

operator of the lighter and/or against the party requesting such service to
be performed.

lighters as are shown to have been caused by it or to have been within its
control.

12. DOCKAGE
WHARFAGE AND STORAGE:
1. Dockage
a. Geared Vessels Loading or Discharging:
Self propelled vessels intending to load or discharge cargo shall be charged
at the following LOA per diem rates for the duration of time at the
load/discharge berth.

b. Roll On Roll
Off Vessels Loading or Dischargingshall be charged at the following LOA per
diem rates for the duration of time at the load/discharge berth.

325 to 400 @ 6.55/ft
400 to 500 @ 7.25/ft
500 to 600 @ 7.95/ft
2. Wharfage
The following charge is assessed when cargo passes over or through
the mooring pier or passes over the side of a vessel for the unloading
to or loading from other vessels or to and from barges, rafts or water.

from day of vehicle arrival. Thereafter and until release from yard occurs
the following rate will apply:
Day 15 to 21 : $ 2.95 per day, per vehicle
Day 22 to 30 : $ 3.30 per day, per vehicle.
Over 30 days : $25.50 per day, per vehicle (plus storage facility transfer
charge of $125.00 per vehicle)
